FMCSA CDL Drug and Alcohol Clearinghouse

You may have been hearing the buzz about the new FMCSA Clearinghouse and wondering exactly what it is for, and how it affects you and your CDL.

Effective January 6, 2020 the FMCSA will require mandatory reporting of a driver's violations of the FMCSA Drug and Alcohol Testing Program 49 CFR (Part 382) to the Clearinghouse, and CDL drivers and employers of commercial drivers can review the driver's Clearinghouse record.

In order for you to view your full Clearinghouse record you are required to register. It's important to check your record periodically to make sure what is being reported is YOUR record as the reporting is linked to your CDL number.

In order for the Commercial Carrier (employer) to review your record, you must give your consent for the employer to do either a Full Query, or a Limited Query.

Beginning January 6, 2020, employers of CDL drivers are required to verify that any current or prospective driver is not prohibited from operating commercial motor vehicles or performing other safety-sensitive functions due to any unresolved drug and alcohol program violation, such as completion of an SAP (Substance Abuse Professional Program) following a positive result.

Registration is now open, and CDL drivers may register by clicking on the link below:

Just as employers are now required to perform an Annual Violation Review of the CDL driver's MVR, they will now have to do an Annual review of the driver's Clearinghouse record of Drug and Alcohol Program violations. In order for the employer to perform what is called a Limited Query, the driver will have to provide consent. FirstFleet will be posting a Consent Document on our Portal in the near future for your signature. This consent will be active for the entire term of your employment.

In the event that a Drug and Alcohol Program violation is found during the Limited Query, your consent will be requested to perform a Full Query of your Clearinghouse records.

Insurance Cab Cards

Just as each of us is required to carry, and show proof of insurance for our personal vehicles, so are the commercial driver and the company. Failure to be able to present a copy of the Insurance Cab Card can result in citations and fines for both the driver, and for FirstFleet.

FirstFleet’s insurance policy effective dates are 4/1 to 4/1 annually. Our current policy runs 4/1/18 to 4/1/19. The Insurance Cab Card should be maintained in the Permit Book for every FirstFleet tractor.

One way to ensure that the card is there is to include a review of the Permit Book in every pre-trip inspection. If you find the document is missing an updated copy can be found on the FirstFleet mobile application. Additionally, your dispatch team can print the document from the company shared drive at any time.

Fuel Spill

In our industry fuel spills happen from time to time when drivers either encounter objects in the roadway or are involved in collisions. When these situations do occur, drivers need to move quickly to mitigate the impact of a fuel spill. Things to remember when a spill occurs:

Try to remain on a paved area whenever possible----do not pull onto soil, sand, etc. as the fuel will saturate the ground, necessitating a costly clean-up.
Avoid areas where water is nearby, and do not park near a drain or any sort of culvert.
Turn the truck off-this stops the fuel from pumping from tank to tank.
Look for ways to stop the spread of fuel, such as using the mattress, bedding…anything to dam the flow and contain it in a smaller area. You will be reimbursed for any damaged personal property used to stop the spill.
A bar of soap or a rag and a screw driver can staunch the flow.
Contact Portland (1-800-489-7300) for assistance in locating a spill clean-up crew.
Call local or state law enforcement as many states require reporting of any fuel spill.

The annual open enrollment for the 2016 benefit year will end as of 10/31/15. Many locations are continuing to have enrollment meetings right up to October 31st, and the website is available 24-7 up until midnight October 31st. The call center will only be available up to 5:00 p.m. on Friday October 30th.

To enroll by telephone Monday - Friday from 8 a.m. - 5 p.m. EST, call 1-866-294-4050 by October 30, 2015. A benefit counselor will explain all the options available to you and your covered dependents.

If you choose to participate via online enrollment you may do so from October 1st - 31st. While most of our locations with more than 10 employees will have enrollers from Colonial Life on site during the month of October to share the attached video and meet with each benefit eligible full-time employee to make their selections for 2014, not everyone's work schedule will allow them to be present for those meetings.

FirstFleet and Colonial Life wanted to make sure every interested employee and their spouses would have the opportunity to view the attached video which reviews the highlights of the 2014 Benefit plan year. Two videos are posted, one that is specific to the state of New York, and the other for all other states. Please take the time to view the video and review the benefit information packets that were mailed to your home in September to make sure you don't miss out on any of the exciting changes coming in 2014.

New disclosure requirements that became law under the Patient Protection and Affordable Care Act (PPACA) directed the Departments of Labor, the Treasury and Health and Human Services to develop standards for a Summary of Benefits and Coverage along with a uniform glossary of health insurance and medical terms.

TTF Scholarship

Attention Tennessee Residents: Don't miss the opportunity to apply for a Tennessee Trucking Foundation scholarship.

The TTF has a NEW WEBSITE THIS YEAR: The CFMT scholarship application process this year is different from past years. The application that is on the CFMT website is "LIVE" and can be accessed here. Tennessee Trucking Foundation (TTF) Scholarships are available for dependent children, spouses or employees of companies who are members in good standing of the Tennessee Trucking Association. Scholarship recipients must be Tennessee residents who are entering their junior or senior years at accredited colleges or universities located in Tennessee.

The student should go to the website above to access the application then create a New Student account (even if they are applying for renewal). The applicant should complete the application which can be saved and finished later, and submit the application when all attachments are in their application. Students who have received the Tennessee Trucking Association scholarship previously will use the application for Past Recipients. The student will complete one application. Students will be notified along the way as they work on their application and when it is submitted by email. The deadline for submission is still March 15. The TTF hopes that the process will be easier and less cumbersome for students.

The scholarship program is administered by the Board of The Community Foundation of Middle Tennessee and applications will be reviewed by a selection committee appointed by them. In evaluating applicants, the committee will consider academic aptitude, test scores, extracurricular activities and financial need. The deadline to submit applications to the Community Foundation for 2012-13 academic year scholarships is March 15, 2012.

Stay on Your Feet - Traction Aids

Summer has passed and Winter seems to be fast on its heels. Winter brings with it wet, slippery and sometimes frozen surfaces which create hazardous conditions for our employees. In order to avoid painful and costly slip and fall injuries the company has added slip-on traction aids to its available personal protective equipment (PPE). These traction aids go on easily over the employee’s existing shoes or work boots.

All drivers and mechanics are expected to wear these traction aids. If you have not already been issued a pair, or need replacement cleats for those issued last year, please follow up with your dispatch supervisor, supervisor or fleet manager to order a pair or to order the replacement cleats. Heat Safety

With rising temperatures of record numbers across the country, FirstFleet wants to convey the importance of knowing how to stay safe in this intense heat. According to the Centers for Disease Control, initial symptoms of a heat emergency include:

hot, dry skin or profuse sweating
extreme weakness or fatigue
pale or flushed complexion
confusion/dizziness
fast, shallow breathing
hallucinations
clammy, moist skin
elevated body temperature
throbbing headache
slurred speech

The quickest and most effective way to treat an individual experiencing a heat emergency is to first call for medical help. The worker should then be moved to an area that is cooler and out of the sun. Heavy or excessive clothing should be removed and cool water should be applied to the person's body. The consumption of water and other cool beverages also aid a person in their recovery.

In the event of a heat related event while on the job, the employee should first seek medical attention or if unable local management should coordinate that treatment and then as soon as is possible, report the incident to FirstFleet at 800-489-7300.

Because there were some issues with the Harmony site closing a day early we had a number of people who had waited until the next to the last day to participate that were unable to make their elections for 2011. We are going to open the call center and the Harmony on-line self-enrollment site again for one day only, Friday November 5^th. The hours are noted below as well as the phone number and website information.

· Upon entering the enrollment system, you will be required to change your password, select and answer a security question, and agree to do business electronically.

· Once you are logged in, you may begin your enrollment by clicking on the “Enter My Enrollment” button on the right side of the Home Page.

Next, follow these steps:

1. Review “Me & My Family.”

2. Choose your plans through “My Benefits.”

3. Click “Finish.”

4. When you click “Finish”, you will be able to view and print a summary of your selections.

Open enrollment will end on 10/31/10 so you need to make sure you don't miss the opportunity to review your current selections and make any changes that will benefit you and your family in the coming year. If you've already met with an enroller, then you're golden, but if not, you can still call the CALL CENTER at (866) 310-3992 Monday through Friday from 8 a.m. to 5 p.m. EST until Friday 10/29/10. Increasing Voluntary Life Insurance Elections

I wanted to remind everyone that you may increase your voluntary life insurance by $10,000.00 without providing evidence of insurability. You may elect coverage up to five (5) times your annual income, but only $10,000.00 of your new elected amount is what is known as guaranteed issue. Anything more than $10,000.00 will require you to submit a form known as an Evidence of Insurability form (EOI) to Reliance Standard. If you meet with a benefit counselor during your location's meetings, if you attempt to elect an increase of more than $10,000.00 the benefit counselor will provide you with an EOI form to complete. Your requested increase in excess of the $10,000.00 guaranteed issue will not go into effect unless approved by Reliance Standard through the EOI process.

You may also request an increase in your spouse's voluntary life insurance in the same way. The only thing to remember is that you cannot have more life insurance on your spouse than you carry on yourself.

If you have already met with a benefit counselor at an on site meeting and did not receive an EOI form to complete for any requested increase over the $10,000.00 you may call the Colonial Life Call Center at 1-866-310-3992 and request the increase and a benefit counselor will send you the EOI form.

Once you complete the EOI form, you should return it to FirstFleet, to the Benefit Department at Corporate office.

Open enrollment for the 2011 benefit year is well under way. Meetings are taking place at all locations with 10 or more employees, the call center is open Monday through Friday from 8:00 a.m. ET to 5:00 p.m. ET, and the self-enroll online site is available again this year. All full-time employees have received packets at their homes outlining the benefits offered for 2011.

The call center number is 1-866-310-3992. The call center is open Monday through Friday from 8:00 a.m. to 5:00 p.m. Eastern Standard Time through October 29th. To view and print benefit information, go to: www.coloniallife.com/callcenter.

Enrollment in Plan 2 Question

In response to Mr. Green's comment on this post:

All employees are subject to the waiting period for electing enrollment in medical Plan 2, however it is actually a fourteen month waiting period that is unique to each employee, and the employee's hire date drives the eligibility date to move to Plan 2. Once an employee has been on Plan 1 for a year he or she will receive a letter from the Benefit department offering the opportunity to move to Plan 2. This is outside, and independent of the annual open enrollment.

Any questions about eligibility, open enrollment, benefit administration, etc. can be referred to the Benefit Department. The number is 800-819-0905.

It’s that time of year again! Our annual open enrollment will begin on Friday, October 1st and run through Sunday October 31st. As in the past there will be enrollers on site at your locations (unless you are at a location with fewer than 10 drivers) at times to be determined by your fleet manager. Additionally we will again have online enrollment capability (available 24-7 once Open Enrollment commences), as well as a call center that will be open Monday through Friday during the month of October. Be watching this site, as well as postings at your terminal for the dates and times Colonial Life enrollers will be there to meet one-on-one with you. Next week I will provide you with the link to the Colonial website and the telephone number and hours of operation of the call center.

The most important thing I need to share with you is a change in the FirstFleet, Inc. 401k plan for 2011. Effective 1/1/11, all full and part-time employees who are NOT currently participating in the 401k plan will automatically be enrolled at 4% of their pre-tax weekly pay. Anyone that does not want to participate will have the option to opt-out by going through this with the enroller or contacting Principal Financial at 1-800-547-7754.

It is very important that you actively participate in this open enrollment by either 1) meeting with an enroller to, 2) going online at the Colonial website to note your benefit elections, or 3) contact the call center and confirm your elections with a Colonial representative.

Finally, please remember that if you are currently enrolled in a an FSA (flexible spending account) for healthcare or dependent care in 2010, that you must meet with an enroller, participate online, or call the call center in order to continue your FSA in 2011.
